Terms and Conditions – Kabak App

1. Acceptance of Terms

By using the Kabak application, creating an account, or placing an order, the user acknowledges full acceptance of, and agreement to be bound by, these Terms and Conditions.

2. Nature of the Service

The Kabak application provides an electronic platform that connects customers with tailoring and custom-fitting service providers. The platform's role is limited to facilitating the ordering process, communication, payment management, and related services.

3. Establishment Disclosure

Kabak undertakes to clearly display the following regulatory information to users:

  • Trade name.
  • Commercial registration number.
  • Tax registration number (if applicable).
  • Establishment's place of business.
  • Official communication channels.
  • Regulatory licenses required to practice the activity.

The user acknowledges that they are dealing with a legally registered establishment in the Kingdom of Saudi Arabia.

4. Domain Ownership and Store URL

Kabak undertakes that the domain name of the online store is owned by the application, or has been granted by an entity authorized to issue subdomains, and that it is not previously registered to any other party. Kabak bears full responsibility for the accuracy and integrity of the information related to the domain.

Kabak also confirms that the store's main URL is not a social media account link (Instagram, Facebook, Snapchat, TikTok), and that such accounts may only be used as supplementary communication channels or links.

5. Alignment of Listed Activities with the Commercial Registration

Kabak undertakes that all products or services offered through the online store comply with applicable regulations and fall within the activities licensed under the application's commercial registration, or within the activities approved under the freelance practitioner certificate, as applicable.

6. Governance, Oversight, and Complaints Handling

Kabak's online store activity is conducted under an entity committed to principles of governance and internal oversight, and to providing a clear mechanism for receiving and addressing customer complaints, as further detailed in the separate Complaints and Dispute Resolution Policy.

7. Accounts and Information

  • The user must provide accurate, correct, and up-to-date information.
  • The user is responsible for maintaining the confidentiality of their login credentials.
  • Kabak reserves the right to suspend or terminate any account containing inaccurate information or misusing the platform.

8. Measurements

  • The customer is responsible for the accuracy of the measurements they enter or approve.
  • By selecting "use previous measurements," the customer confirms that those measurements remain accurate and suitable.
  • Kabak and the tailor bear no responsibility for sizing discrepancies resulting from changes in the customer's measurements or a failure to update them.

9. Fabrics and Materials

  • Colors of fabrics or materials displayed online may differ slightly from the actual product due to screen settings or manufacturing batch variations.
  • All orders are subject to the availability of fabrics and materials from suppliers.

10. Prices and Payment

  • All displayed prices include or exclude VAT, as indicated within the application.
  • Order amounts are collected using the payment methods supported within the application.
  • Kabak reserves the right to adjust prices in the future without affecting previously confirmed orders.

11. Order Fulfillment

  • Orders are fulfilled by tailors or entities contracted with Kabak.
  • The displayed fulfillment timeframe is an estimate and may be affected by operational conditions, seasonal demand, or circumstances beyond Kabak's control.

12. Nature of the Relationship with Service Providers

The user acknowledges that tailors and service providers registered with Kabak may be independent service providers, and that Kabak's role is limited to providing the technical platform and managing orders, payments, and support services in accordance with its approved policies.

13. Delivery

Delivery times depend on the shipping companies or authorized delivery agents. Kabak bears no responsibility for delays caused by transportation conditions or incorrect addresses provided by the customer. For further details, please refer to the separate Shipping and Delivery Policy.

14. Modifications

  • The customer may request modifications in accordance with the policy published within the application.
  • Modifications required due to inaccurate or changed measurements are not the responsibility of Kabak or the tailor.

15. Cancellation and Return

  • An order cannot be cancelled once cutting, tailoring, or fulfillment has begun.
  • Due to the personalized nature of made-to-order products, returns are accepted only in cases of confirmed manufacturing defects.
  • Return or compensation requests are evaluated in accordance with Kabak's approved policy. For further details, please refer to the separate Cancellation and Refund Policy.

16. Intellectual Property

All trademarks, logos, designs, and content belonging to Kabak are owned by the platform and may not be used or copied without prior written consent.

17. Trademark Commitment

Where a trademark registered in Kabak's name is valid and accredited with the Saudi Authority for Intellectual Property, Kabak undertakes to maintain its validity and good standing. Where no registered trademark exists, Kabak undertakes not to infringe upon any trademark previously registered by another party, and shall bear sole and full responsibility for any violation in this regard under the Intellectual Property Protection Law of the Kingdom of Saudi Arabia.

18. Intellectual Property Rights in Customer-Uploaded Content

The customer represents that they own, or have the legal right to use, any images, designs, or files they upload through the application. The customer bears full responsibility for any claims or disputes relating to intellectual property rights in the content they submit.

19. Prohibited Conduct

Use of the application for any unlawful, abusive, or fraudulent purpose, or in a manner that violates applicable regulations in the Kingdom of Saudi Arabia, is prohibited.

20. Limitation of Liability

Kabak shall not be liable for any indirect damages, consequential losses, or lost profits arising from the use of the application or the services provided through it, to the extent permitted by applicable regulations.

21. Force Majeure

Kabak shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including natural disasters, pandemics, government decisions, or major technical failures.

22. Privacy

The user agrees to the collection and processing of data necessary to provide the service in accordance with Kabak's approved Privacy Policy (see the separate Privacy Policy).

23. Electronic Communications Consent

The user agrees to receive notifications and messages related to orders and services through the application, email, text messages, or the contact methods registered on their account.

24. Consumer Rights

Kabak complies with the laws and regulations applicable in the Kingdom of Saudi Arabia relating to consumer protection and e-commerce. Consumers are entitled to receive clear information about products, services, prices, and fulfillment timeframes prior to completing a purchase. 25. Amendment of Terms

Kabak reserves the right to amend these Terms and Conditions at any time. Continued use of the application after such amendments are published constitutes acceptance of them.

26. Governing Law

These Terms and Conditions are governed by the laws and regulations of the Kingdom of Saudi Arabia, and the Saudi courts shall have exclusive jurisdiction over any dispute arising from them.

Cancellation and Refund Policy – Kabak

Order Cancellation

  • Customers may cancel an order before fulfillment begins.
  • An order cannot be cancelled once cutting, tailoring, or fulfillment has begun.

Made-to-Order Products

Due to the nature of products designed or tailored specifically for the customer, they are not eligible for return or exchange except in cases of confirmed manufacturing defects.

Returns

Customers may submit a return request within 7 days of receiving the product in the event of:

  • A clear error in order fulfillment.
  • A manufacturing defect.
  • A material deviation from the approved specifications.

Returns Do Not Cover

  • A change of mind after fulfillment.
  • Changes in the customer's measurements after the order has been approved.
  • Minor variations that do not affect the normal use of the product.

Refunds

If a return request is approved, the amount is refunded to the original payment method within the applicable statutory period.

Shipping and Delivery Policy – Kabak

General Provisions

  • Orders are delivered to the address specified by the customer.
  • Delivery times vary depending on the city, product type, and fulfillment schedule.
  • The customer is responsible for the accuracy of the delivery address and contact information.
  • If delivery cannot be completed due to incorrect information, additional re-shipping fees may apply.
  • Customers are notified of any material delivery delay as soon as it becomes known.

Complaints and Dispute Resolution Policy – Kabak

Submitting Complaints

  • Customers may submit a complaint or feedback through Kabak's official communication channels.
  • Kabak is committed to reviewing complaints and responding within no more than 5 business days.
  • In the event of a dispute between the customer and a service provider, Kabak will review the matter and take appropriate action in accordance with its approved policies.
